This translation is provided for information purposes only. In the event of any discrepancy, the French version shall prevail.
Preamble
These terms of sale govern all sales concluded between Overcut (sole trader, SIRET 93310620500018, not subject to VAT under Article 293B of the French General Tax Code) and any buyer making a purchase on the website www.overcut.fr. Any purchase implies full and unreserved acceptance of these terms of sale.
Article 1 — Products
The products offered for sale are described as accurately as possible. Photographs and visuals are provided for guidance only. Overcut reserves the right to modify its catalogue at any time without notice. Products are available while stocks last.
Article 2 — Prices
Prices are stated in euros, all taxes included. Overcut is not subject to VAT under Article 293B of the French General Tax Code. Shipping costs are indicated before the order is confirmed. Overcut reserves the right to change its prices at any time; products are invoiced on the basis of the rates in force at the time the order is confirmed.
Article 3 — Orders
Placing an order implies acceptance of these terms of sale. The order is confirmed once payment has been validated. Overcut reserves the right to cancel any order in the event of a supply problem or suspected fraud. In that case, the customer will receive a full refund.
Article 4 — Payment
Payment is made online by bank card via the secure Shopify Payments platform. Bank details are encrypted and are never stored on our servers. Your card is charged when the order is confirmed.
Article 5 — Shipping
Orders are shipped from France within 1 to 2 business days after payment confirmation. Delivery times are 4 to 6 business days in mainland France and 6 to 8 business days in Europe. Shipping is free on orders of €80 or more. Overcut cannot be held liable for delays attributable to the carrier.
Article 6 — Right of withdrawal
In accordance with Article L221-18 of the French Consumer Code, the customer has 14 days from receipt of the order to exercise their right of withdrawal, without giving any reason. To exercise this right, the customer must contact Overcut at contact@overcut.fr, stating their order number. Returned items must be unworn, in their original packaging and free of any signs of use. Return shipping costs are borne by the customer.
Article 7 — Refunds
The refund or store credit will be issued within 5 business days of receipt and inspection of the return. Refunds are made to the payment method used for the order. Store credit is valid for 12 months across the entire Overcut store.
Article 8 — Warranties
Overcut products are covered by the legal warranty of conformity (Articles L217-4 to L217-14 of the French Consumer Code) and the warranty against hidden defects (Articles 1641 to 1648 of the French Civil Code). In the event of a defective or non-conforming product, the customer may contact Overcut at contact@overcut.fr within 15 days of receipt.
Article 9 — Intellectual property
All content on the site (texts, images, visuals, logos, embroidery) is the exclusive property of Overcut and is protected by intellectual property laws. Any unauthorised reproduction is strictly prohibited.
Article 10 — Personal data
Personal data collected when an order is placed is used solely to process that order. In accordance with the GDPR, the customer has the right to access, rectify and delete their data by contacting contact@overcut.fr.
Article 11 — Disputes
In the event of a dispute, an amicable solution will be sought before any legal action is taken. The customer may use the European online dispute resolution platform available at ec.europa.eu/consumers/odr. Failing an amicable resolution, the French courts shall have exclusive jurisdiction.
Article 12 — Governing law
These terms of sale are governed by French law. They were drawn up in French and only the French version is authoritative.
